A federal judge has mandated that the Trump administration disclose details about the individuals responsible for designing a proposed $1.8 billion fund intended to compensate those who claim they were victims of political prosecution. This directive was issued by U.S. Magistrate Judge Ivan Davis within the context of a lawsuit challenging the fund’s creation. The lawsuit, filed by Democracy Forward, represents several plaintiffs, including a former federal prosecutor and a college professor acquitted of charges stemming from a protest against an immigration raid.
Last month, the Justice Department announced that the proposed fund had been scrapped. Todd Blanche, a former Justice Department official, confirmed that the fund was effectively defunct, having never been operational. The compensation program was initially conceived as part of a settlement involving President Donald Trump and the Internal Revenue Service, sparking controversy over its potential to compensate individuals prosecuted in connection with the January 6, 2021, Capitol attack, among other cases.
The proposed fund faced bipartisan opposition, with criticism from lawmakers across the political spectrum, including Republican senators. Concerns were raised over whether the program could be revived despite its official abandonment. In a separate ruling in July, a federal judge determined that Trump’s lawsuit against the IRS lacked a legitimate legal dispute, suggesting it had been primarily used to facilitate the settlement that laid the groundwork for the proposed fund.
Despite the administration’s decision to abandon the program, Trump has expressed his disappointment, asserting his belief that certain individuals were treated unjustly. The recent court order requiring more transparency about the fund’s creation could illuminate how the fund was structured and whether there are any lingering intentions to seek compensation through alternative channels.
